By using the Services, you agree that all disputes, claims, or controversies arising from or related to these Terms or your use of the Services will be resolved individually, not as part of a class or collective action.

You waive the right to participate in any class, consolidated, or representative action against Clear Search or its operators. All arbitration or legal proceedings will be conducted on an individual basis only — no class arbitrations or private attorney general actions are permitted.

This waiver is a material, non-severable part of these Terms. You acknowledge that you are waiving the right to a jury trial and to act as a plaintiff or class member in any collective proceeding. If this clause is deemed unenforceable in a specific jurisdiction, the remaining Terms shall remain fully enforceable.

To use our Services, you must provide a valid email address. Platform access is granted via a magic link sent to your email. You agree to provide accurate and up-to-date information and to maintain the confidentiality of your access credentials.

Access is provided only after initiating a trial purchase priced at $1.00 or $3.99 for new U.S. users. All pricing is displayed before purchase, and users receive confirmation via email after payment.

You may request permanent account deletion, including all associated data, through our designated account deletion page. Verification is required via a one-time password (OTP) sent to your registered email.

Subject to your compliance with these Terms, ClearSearch grants you a limited, non-exclusive, revocable, non-transferable, and non-sublicensable license to use the Services solely for personal, non-commercial purposes.

You may not copy, scrape, modify, reverse-engineer, or otherwise misuse the Services or their content. Any unauthorized use automatically terminates this license and may result in legal action.

All data, reports, and materials ("Content") provided through the Services are for informational purposes only. While we strive for accuracy, we make no guarantees that the information is complete, current, or error-free.

By using our Services, you acknowledge that the Content:

• Is provided "as is" and may contain limitations inherent to data sources.
• Should not be relied upon for legal, financial, employment, or other critical purposes.
• May not fully meet your expectations or intended use.

Our Services may allow users to post, upload, or submit content such as text, images, videos, feedback, or other materials ("Contributions"). By providing any Contributions, you acknowledge and agree that:

• You are solely responsible for the content you post and any outcomes resulting from it.
• You own or have the legal right, license, or permission to share your Contributions and to grant us the right to use them.
• Your Contributions do not infringe upon any third party's intellectual property or privacy rights.
• Your Contributions are not false, misleading, or deceptive.
• Your Contributions do not contain unauthorized advertising, spam, pyramid schemes, or other forms of solicitation.

By submitting Contributions, you grant ClearSearch a non-exclusive, worldwide, royalty-free, perpetual, and transferable license to use, display, reproduce, distribute, and create derivative works from your Contributions in connection with operating and improving the Services.

We reserve the right, at our sole discretion, to modify, suspend, or discontinue any part of the Services at any time without prior notice or liability. This includes changes to functionality, pricing, subscription plans, or service availability.

We further reserve the right to:

• Update or amend these Terms at any time. Changes will take effect upon posting or notifying users directly.
• Restrict or terminate access to any user suspected of misuse, fraud, or violating these Terms.
• Review, monitor, or remove any content or user activity that we consider inappropriate, unlawful, or harmful.
• Enforce these Terms and applicable laws through account suspension, termination, or other lawful measures.

We offer flexible subscription options, including weekly and monthly plans. All users start with a paid 7-day trial, which provides limited access to premium features.

All payments are securely processed through PCI-DSS-compliant systems. Subscriptions auto-renew unless canceled before the next billing cycle.

By subscribing, you agree to automatic renewals, applicable regional pricing, and the non-refundable nature of most charges. For billing questions, contact our Support Team.

By using our Services, you acknowledge that ClearSearch is not a consumer reporting agency as defined by the Fair Credit Reporting Act (FCRA), 15 U.S.C. §1681 et seq.

The information we provide cannot be used to determine a person's eligibility for:

• Insurance,
• Employment,
• Housing, or
• Any other use governed by the FCRA.

Our platform is strictly for informational and personal use only and must not be used to evaluate a person's creditworthiness, character, or reputation for regulated purposes.

ClearSearch's Services are not "consumer reports" under the FCRA. The information provided is not gathered or used to assess eligibility for:

• Personal, family, or household credit or insurance;
• Employment decisions (e.g., hiring or termination);
• Housing or rental approvals;
• Education admissions, government benefits, or any other regulated decision.

All data is provided solely for informational purposes. Users are fully responsible for ensuring compliance with applicable laws when using the information obtained through our Services.

By using our Services, you consent to receive transactional and service-related communications from us. These may include emails regarding your account, purchases, subscription renewals, updates, and important system notifications. Such messages are essential for operating the Services and cannot be disabled unless you delete your account.

If you start a reverse image lookup but do not complete your purchase, we may send you reminder emails that include the image you uploaded to help you finalize the process. You can opt out of these reminders at any time by clicking the unsubscribe link in the email.

You may cancel your subscription at any time using one of the following methods:

• Visit our Help Center and access the cancellation hub, where you can enter your account email and request cancellation.

Upon successful cancellation, you will retain access to the Services until the end of your current billing cycle. After that, no further charges will apply.

By using the Services, you agree to adhere to the following obligations:

• Lawful and Ethical Use: You must use the Services only for legal and authorized purposes and in full compliance with applicable laws and these Terms.
• Personal Use Only: The Services are for your individual, non-commercial use. You may not resell, distribute, or share any data obtained through the platform.
• No FCRA-Regulated Use: You may not use the Services to determine someone's eligibility for credit, insurance, employment, housing, or any purpose governed by the Fair Credit Reporting Act (FCRA).
• Accuracy of Information: You are responsible for ensuring that all information you provide is accurate, current, and complete.
• Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities occurring under your account.

When using the Services, you agree not to engage in any prohibited or unlawful activities, including but not limited to:

• Unauthorized Access: Attempting to access systems, networks, or data without permission.
• Automated Data Collection: Using bots, scripts, scrapers, or similar tools to extract or harvest information.
• Reverse Engineering: Attempting to decompile, disassemble, or analyze the platform's underlying code or algorithms.
• Improper Use of Data: Using obtained information for FCRA-regulated or unlawful purposes.
• Reselling or Redistribution: Sharing, copying, or reselling reports or data without written authorization.
• Service Disruption: Engaging in actions that interfere with or damage the performance or integrity of the platform.

You agree to indemnify, defend, and hold harmless ClearSearch, its affiliates, officers, directors, employees, agents, licensors, and service providers (collectively, the "Indemnified Parties") against all claims, damages, liabilities, and expenses (including reasonable attorney's fees) arising from or related to:

• Your misuse or unauthorized use of the Services or data obtained from them;
• Any breach of these Terms or applicable laws;
• Claims by third parties related to your use of the Services, including data misuse or intellectual property violations;
• Your reliance on, distribution of, or actions taken based on information obtained through the Services;
• Unauthorized access or activity on your account.

We reserve the right to assume exclusive control over any claim subject to indemnification, and you agree to cooperate fully in the defense of such matters. You may not settle any claim involving the Indemnified Parties without our prior written consent.

To the maximum extent permitted by law, ClearSearch, its affiliates, and related entities (collectively, the "Released Parties") shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from your use of, or inability to use, the Services. This includes but is not limited to:

• Loss of Data: Deletion, corruption, or inaccessibility of reports or information.
• Business Interruption: Lost profits, revenue, or business opportunities.
• Third-Party Claims: Disputes or liabilities resulting from your use of our data or Services.
• Service Downtime: Interruptions or technical failures beyond our control.
• Data Accuracy: Errors, omissions, or outdated information in reports.

In any case, the total liability of the Released Parties shall not exceed the greater of:

• The total amount you paid for access to the Services during the six (6) months preceding the incident, or
• $100 USD, if no payments have been made.

This limitation applies regardless of the form of the claim (contract, tort, negligence, or otherwise) and even if the possibility of such damages was known.

The Services are provided "as is" and "as available" without any warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, ClearSearch and its affiliates, officers, directors, employees, agents, licensors, and service providers (collectively, the "Disclaiming Parties") expressly disclaim all warranties, including but not limited to:

• Implied Warranties: Any implied warranties of merchantability, fitness for a particular purpose, non-infringement, and data accuracy.
• Service Availability: That the Services will be uninterrupted, error-free, or free from harmful components such as viruses or malware.
• Accuracy of Information: That the data, reports, or materials provided through the Services are complete, accurate, or reliable.
• Results or Outcomes: That the Services will meet your expectations or deliver specific results.

You acknowledge that your use of the Services is entirely at your own risk.

You agree that any unauthorized use of the Services — including, but not limited to, misuse of data, intellectual property violations, or breach of these Terms — may cause irreparable harm to ClearSearch and its affiliates. In such cases, monetary damages may not provide sufficient compensation. Therefore, ClearSearch reserves the right to seek injunctive or equitable relief without the need to post a bond or other security, in addition to any other remedies available under law.

To maintain the integrity and safety of the platform, you agree not to engage in the following prohibited activities:

• Illegal Activities: Using the Services for unlawful purposes or in connection with criminal behavior.
• Intellectual Property Infringement: Uploading, sharing, or distributing content that violates the intellectual property rights of others.
• Harassment or Abuse: Engaging in harassment, bullying, or any form of threatening behavior.
• Misrepresentation: Impersonating another person or misrepresenting your identity or affiliation.
• Spam or Malware: Distributing spam, malicious code, or other harmful software.
• Interference with Services: Disrupting or attempting to compromise the functionality of the platform.
• Offensive Content: Posting content that is violent, pornographic, discriminatory, or otherwise inappropriate.
• Bypassing Security: Attempting to circumvent access controls or security mechanisms.

Any violation of this section may result in account suspension, termination, and potential legal action.

Your privacy is a priority at ClearSearch. By using the Services, you acknowledge that any personal data you provide, or that we collect, is handled in accordance with our Privacy Policy.

We use collected data to operate, improve, and secure our Services while ensuring compliance with applicable laws. Uploaded images used in reverse image lookups are stored temporarily for five (5) days before being automatically deleted to protect user privacy and maintain data security.

By continuing to use the Services, you consent to our data processing practices as described in the Privacy Policy.

We respect your right to control your personal information and provide a clear opt-out mechanism for removing personal data from our publicly available search results.

To request removal of your phone number or email address, follow these steps:

This process ensures only verified users can request data removal and helps maintain database integrity.

The Services may contain links to external websites or third-party resources provided solely for your convenience. These links do not imply endorsement or control by ClearSearch.

When you access external sites, you do so at your own risk and are subject to those sites' respective terms of use and privacy policies.

ClearSearch is not responsible for any damage, loss, or issues arising from your use of or reliance on third-party content, products, or services.

All content and materials available through the Services — including text, graphics, software, logos, images, and data compilations (collectively, "Content") — are the exclusive property of ClearSearch, its affiliates, or its licensors, and are protected by intellectual property laws.

• Ownership: All rights, title, and interest in the Services and Content remain with ClearSearch and its licensors.
• Limited License: You are granted a non-exclusive, non-transferable, revocable license to access and use the Services solely for personal or authorized business purposes, as permitted by these Terms.
• You may not copy, modify, reproduce, distribute, or create derivative works from the Services or Content without prior written consent.

To ensure fair and efficient resolution of disputes, the following process applies:

This arbitration agreement does not prevent either party from seeking injunctive relief or other equitable remedies in court for intellectual property violations or unauthorized data use.

These Terms and your use of the Services are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law provisions. You agree that any disputes, claims, or controversies arising out of or related to these Terms, the Services, or your use of the Services shall fall under the exclusive jurisdiction of the state and federal courts located in Delaware.

For users located within the European Union (EU) or European Economic Area (EEA), these Terms are likewise governed by the laws of Delaware, USA—without prejudice to any mandatory local consumer protection laws in your country of residence. Any disputes arising from or related to these Terms may also be brought before the competent courts of Delaware, USA.

ClearSearch reserves the right to modify, update, or revise these Terms at any time, without prior notice. Any changes take effect immediately upon posting on our website or within our Services.

It is your responsibility to review these Terms periodically to remain informed of any updates. By continuing to use our Services after revisions have been made, you agree to be bound by the updated Terms.

We may revise these Terms to reflect changes in our business practices, legal obligations, or to improve the functionality and clarity of our Services. When material updates occur, we will make reasonable efforts to notify users through the website or by email.

Failure or delay by ClearSearch to exercise any right, power, or remedy under these Terms shall not constitute a waiver of that right or any other rights herein.

Any waiver of a breach or provision must be in writing and signed by an authorized representative of ClearSearch to be valid. Such a waiver applies only to the specific instance and shall not be interpreted as a continuing waiver of subsequent breaches or defaults.

All clauses and provisions shall be interpreted based on their plain language and intended purpose, regardless of the use of headings or formatting.

If any provision or part of these Terms is determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such determination shall not affect the validity and enforceability of the remaining provisions.

The invalid or unenforceable clause will be modified, to the extent legally possible, to reflect the original intent of the provision. If modification is not feasible, that specific clause will be deemed severed, while the remainder of the Terms shall remain in full effect.

These Terms, together with all referenced or incorporated documents—including the Privacy Policy, Cookie Policy, and any applicable supplemental terms—constitute the entire agreement between you and ClearSearch regarding the use of the Services.

This agreement supersedes all prior understandings, whether written or oral, relating to the same subject matter. You acknowledge that you have not relied on any representations, promises, or warranties not expressly stated in these Terms.

Any modifications or amendments must be made in writing and signed by an authorized representative of ClearSearch. No verbal agreements or informal communications shall alter or override these Terms.
